What each tier includes.
RFP Tree is offered as a free tier plus two independent paid surfaces: database subscriptions (monthly per-seat access to the full feed and pipeline tools) and agentic queries (pay-as-you-go top-up balance for programmatic queries against the live RFP Tree index).

Database subscriptions and agentic queries are independent. You can subscribe to a database tier, top up an agentic balance, both, or neither. Specific feature limits (queries per month at each tier, seat counts, query response shape) are stated on the pricing page and on your invoice or balance dashboard. The data, the search, and the Estate.
2.1 We provide a UX layer on publicly-available data
RFP Tree aggregates and normalizes data from public government sources, including SAM.gov (active solicitations, awards, entities, exclusions, and the FPDS / eSRS data SAM absorbed in February 2026), USAspending.gov, Grants.gov, SBIR.gov, the Challenge.gov successor for prize competitions, and various state and local procurement portals.
We don't own this data. The accuracy and completeness of any opportunity in RFP Tree depends entirely on the original source. We make no representation that the data is correct, complete, current, or fit for any particular purpose. Verify any opportunity with the issuing agency before relying on it for a bid, application, or business decision.
2.2 We provide a search, eligibility, and analysis layer
We add Smart Search natural-language querying, auto-extracted eligibility metadata, saved searches, alerts, pipeline tracking, and AI-assisted summarization and recommendations. This layer uses artificial intelligence. AI-generated summaries, recommendations, and eligibility extractions may contain inaccuracies or errors. Any similarities between AI output and existing third-party works are unintentional. AI output is informational, not legal or professional advice. You are solely responsible for decisions or actions based on AI output.
2.3 We provide an Estate surface
Your Estate (my_estate.html) lives in your browser's IndexedDB. It never leaves your device unless you pay for cloud sync. When you do pay for sync: we store an encrypted copy across your devices; we do not read it; we do not train AI on it; we do not share it; we do not analyze it for product improvement; we delete it within 30 days of cancellation. Your Estate data is yours. We claim no ownership and no license except the bare minimum needed to perform the sync you paid for.
2.4 We may change or discontinue parts of the Service
We add, modify, and remove features. If a material change negatively affects you, we'll provide reasonable advance notice (except for legal compliance, abuse prevention, or security). If we discontinue a feature, we'll give you a window to export your data. We may amend these Terms. For paid customers, material changes take effect at your next renewal. For free-tier users, material changes take effect 30 days after we post and notify by email. Continued use after a change means you accept it.
The rules.
3.1 Follow the law and respect others
Use the Services only in compliance with applicable law. Don't use them to violate anyone's intellectual property, privacy, publicity, or other rights; harass, defraud, defame, or impersonate; send unsolicited bulk messages to contacts surfaced through RFP Tree; conduct surveillance, profile individuals based on sensitive personal information, or violate the Universal Declaration of Human Rights; discriminate against any individual or group; or submit content that's obscene, threatening, illegal, or contains malware.
3.2 No scraping. No competitive use. No AI-training on our data.
You may not, except as expressly permitted by your tier:
- Use any robot, spider, crawler, scraper, or other automated tool to access the Services
- Send more requests to the Services in a given period than a human can reasonably produce using a normal browser
- Bypass robots.txt, rate limits, paywalls, or any technical access control
- Reverse engineer, decompile, or disassemble the Services
- Use the Services or the data we provide to create, train, fine-tune, or operate any generative AI model, large language model, or service that competes with RFP Tree
- Resell, sublicense, redistribute, or republish the Services or any substantial portion of the data
- Use the Services for benchmarking, competitive intelligence, or to develop a competing product
Access inconsistent with this Section is unauthorized for the purposes of state and federal law, including the Computer Fraud and Abuse Act.
If you're on the API tier (botmarket.rfptree.com), programmatic access through your API key is permitted within your purchased rate limits. Your API key may not be shared. AI agents may consume the API in real time on behalf of an authenticated principal. Bulk caching, mirroring, or republishing the API output to create a competing service is prohibited.
3.3 Don't share your account
Each Authorized User credential is for one human. Don't share passwords, API keys, or session cookies. If we detect sharing (multiple concurrent IPs, unusual usage patterns) we may suspend the account without refund. For Enterprise accounts with multiple seats, the customer's administrator manages who has each seat and is responsible for revoking access when a user leaves.
3.4 Don't abuse free trials or free tiers
Multiple accounts, multiple payment methods, alternate emails, or any other circumvention of free-trial or free-tier limits is prohibited. Violations result in immediate termination of all related accounts, forfeiture of any data or pipeline content stored, and may result in legal action.
3.5 Don't compete with us using our data
You represent that you are not a competitor of RFP Tree, and you are not using the Services to develop, evaluate, or operate a competing product. We may terminate immediately if we have a good-faith belief that you're violating this representation, including by being a consultant to or investor in a non-public competing company.
What you submit, and what we do with it.
You may submit content through the Services: saved searches, pipeline notes, custom field values, Estate data, AI prompts, feedback. We call all of this "Your Content."
4.1 You own Your Content
Your Content remains yours. We claim no ownership.
4.2 The license you grant us
You grant us only the licenses we need to operate the Services for you:

These licenses last only as long as you keep Your Content in the Services. When you remove content, we stop using it within 30 days, except for backup copies we delete within 90 days and de-identified abuse-detection logs we may retain longer.
4.3 You're responsible for Your Content
You confirm you have the right to submit Your Content. You're responsible for ensuring it's accurate, lawful, and doesn't infringe anyone else's rights.
What's ours.
The Services, including the user interface, the eligibility extraction logic, the Smart Search models, the normalized data layer, the Estate browser, and our trademarks, are owned by RFPTree and our licensors. We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Services for your internal business purposes during your subscription period, subject to these Terms. You may share short, attributed excerpts from RFP Tree in internal business communications. You may not republish, redistribute, or systematically share the data externally.
How payment works.
6.1 Subscription fees
Pro, Premium, and Enterprise are billed in advance on the cycle you select (monthly or annual). Credit-card processing fees are passed through. Sales tax is your responsibility. Payments are nonrefundable, except as required by law or as stated in our refund policy.
6.2 Agentic balance (top-up)
Agentic queries at botmarket.rfptree.com are paid from a pre-paid balance you top up in fixed amounts. Each query deducts $0.01 from your balance. Your balance does not expire by date, but it is non-refundable once paid. If you stop using the agentic queries surface, any remaining balance simply sits unused on your account; you can return at any time and continue spending it.
6.3 Late payments
Past-due invoices accrue 1.5%/month interest (or the legal maximum, whichever is lower). After 30 days past due, we may suspend the account. After 60 days, we may terminate and pursue collection. Customer pays reasonable collection costs, including attorneys' fees.
6.4 Auto-renewal
Subscriptions auto-renew at the then-current rate. We notify you at least 30 days before any price increase. To cancel, give us written notice (email info@rfptree.com) at least 30 days before your renewal date. Cancellation takes effect at the end of your current paid period. You're responsible for any payments owed for the current period.
6.5 Free tier
Free-tier accounts have no fees. We may impose query caps, feature limits, and inactivity-based deletion (after 18 months of no login). Free-tier service is provided as-is and may be suspended, modified, or terminated at any time without notice.
6.6 Refunds
If you need a refund, write info@rfptree.com within 14 days of the charge. Include the email address on the account and the date of the charge. We review requests case by case. Outside the 14-day window, fees are non-refundable; the cancellation flow stops future charges.
How either of us ends this.
7.1 By you
You may cancel any time per Section 6.4. Estate data is yours and exportable from your browser at any time without our involvement. Your pipeline, saved searches, and account-resident data are exportable from your account dashboard for 30 days after cancellation; after that we delete them.
7.2 By us
We may suspend or terminate your access if you materially or repeatedly breach these Terms; we're required to by law or court order; your conduct causes harm or liability to a user, a third party, or us; you haven't logged in for 18+ months (free tier only); or you don't pay an invoice within 60 days. We'll provide reasonable advance notice unless doing so would cause harm, violate law, compromise security, or compromise an investigation.
7.3 Effect of termination
You stop having access. You delete any RFP Tree data you've cached locally (other than your own Estate). We retain de-identified usage logs for abuse-detection and security purposes per our Privacy Policy. Sections 4 (retained-backup licenses), 5 (IP), 6 (fees due), 8 (warranty disclaimer), 9 (liability), 10 (indemnification), and 11 (governing law) survive termination.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, RFP TREE AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND TIMELINESS.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE DATA WILL BE COMPLETE, CURRENT, OR ACCURATE. THE DATA COMES FROM PUBLIC GOVERNMENT SOURCES WHOSE ACCURACY WE CANNOT CONTROL OR CORRECT.
DO NOT RELY ON THE SERVICES FOR LEGAL, PROCUREMENT, REGULATORY, OR PROFESSIONAL ADVICE. ANY CONTENT REGARDING THOSE TOPICS IS INFORMATIONAL ONLY AND IS NOT A SUBSTITUTE FOR ADVICE FROM A QUALIFIED PROFESSIONAL.
The cap.
TO THE EXTENT PERMITTED BY LAW, RFP TREE'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES IS LIMITED TO:

IN NO EVENT IS RFP TREE LIABLE FOR LOST PROFITS, REVENUES, BUSINESS OPPORTUNITIES, GOODWILL, ANTICIPATED SAVINGS, INDIRECT OR CONSEQUENTIAL LOSSES, OR PUNITIVE DAMAGES, regardless of the theory of liability and even if we've been advised of the possibility.
These limitations don't apply to: (a) fraud, (b) death or personal injury caused by our negligence, (c) our infringement of a third party's IP rights, or (d) anything law won't allow us to limit.
If a third party sues us because of you.
If you're using the Services on behalf of a business or organization, you'll indemnify RFP Tree (and our directors, officers, employees, and contractors) for any third-party legal proceedings, including claims, losses, damages, judgments, fines, litigation costs, and legal fees, arising from your unlawful use of the Services, your breach of these Terms, Your Content, or your unauthorized sharing of credentials or API keys.
Where this gets settled.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. The UN Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act do not apply.
Any dispute arising out of or related to these Terms or the Services will be resolved exclusively in the state or federal courts of the State of Delaware. You and RFP Tree consent to personal jurisdiction in those courts.
No class actions. Any dispute must be brought on an individual basis. You waive any right to participate in a class, consolidated, or representative proceeding.
Time limit. No action arising out of these Terms may be brought more than one (1) year after the cause of action arose, except for nonpayment or IP-rights claims.
Boilerplate.
Entire agreement. These Terms (with the Privacy Policy and any tier-specific Order Form or Schedule) are the complete agreement between us. They supersede prior agreements and override any conflicting terms in your purchase order or other document.
No assignment by you. You can't assign these Terms or your account without our written consent. We may assign without your consent.
Independent contractors. Nothing here creates a partnership, joint venture, or employment relationship.
Severability. If any clause is unenforceable, the rest stays in effect.
No waiver. Our failure to enforce any clause isn't a waiver.
No third-party beneficiaries.
Force majeure. Neither party is liable for delays caused by events beyond reasonable control.
Notices. To us: info@rfptree.com. To you: the email on your account.
Supplemental terms for the API tier.
Applies in addition to Sections 1 through 12 if you're on the API tier.
- Authorized use: programmatic queries against the documented API endpoints using a valid API key
- Rate limits: stated on the developer portal; bursts above your tier's burst ceiling will be throttled
- AI agents: explicitly permitted to consume the API in real time on behalf of an authenticated principal
- Prohibited: sharing API keys, mirroring or caching API output to create a substitute service, training models on aggregated query results
- Balance: pre-paid top-up; each query deducts $0.01. Unused balance does not expire by date but is non-refundable.
- No SLA without Enterprise: API availability is best-effort unless you have an Enterprise contract with a stated SLA
- Per-query liability: if a single API call returns inaccurate data and you pay for that call, your remedy is a credit refund for that single call. There is no consequential damages liability.
Supplemental terms for cloud-synced Estate.
Applies in addition to Sections 1 through 12 if you've enabled cloud sync for your Estate.
- Encryption: Estate cloud-sync data is encrypted in transit and at rest
- No reading: we do not decrypt, analyze, or train on Estate cloud-sync data
- No sharing: we do not share Estate cloud-sync data with any third party except as required by law
- Deletion: we delete Estate cloud-sync data within 30 days of cancellation or your written deletion request
- Export: you can export your full Estate at any time from
my_estate.htmlwithout our involvement - Sync conflicts: when two devices write to the same Estate file, the later timestamp wins; we keep no merge-conflict history
